This Privacy Policy (“Privacy Policy”) defines what exactly we collect, how we use and store information, with whom we may share it, and the measures we take to ensure that the information provided remains private and protected.

This Privacy Policy is an integral part of the Public Offer for Users and the Public Offer for Partners (hereinafter referred to as the “Terms of Use”), available on our Website (as amended from time to time). The terms and definitions used in this Privacy Policy are defined in the Terms of Use.

Please carefully read the following information to understand our practices regarding your information and how we use it. By continuing to use our Website, you acknowledge that you have read, understood, and accepted the information described in this Privacy Policy. For the purposes of this Privacy Policy, a User, as defined in the Public Offer for Users, and a Partner, as defined in the Public Offer for Partners, are hereinafter collectively referred to as “Users.” If any User does not agree with this Privacy Policy in whole or in part, such User must not use the Website.

By registering on the Website, entering personal data and/or providing such data in any other way, and/or performing any actions within the Website and/or using any part of the Website and/or by giving consent—by activating the “Register” button via the Website form (checkbox)—the User agrees to the provisions of this Policy and grants LLC “JAM DEVELOPMENT,” as well as third parties providing services to LLC “JAM DEVELOPMENT,” including but not limited to payment processing and delivery services, permission to process their personal data.

Accordingly, we, LLC “JAM DEVELOPMENT” (EDRPOU code 41617839), are the data controller for the data processed under this Privacy Policy.

Data processing means any action performed on data, including but not limited to: access, provision, dissemination, collection, systematization, storage, accumulation, recording, transfer, blocking, deletion, clarification, updating and/or modification, anonymization, and other methods of use by LLC “JAM DEVELOPMENT.”

SECTION 2. COLLECTION, PROCESSING, AND USE OF YOUR INFORMATION

2.1. Information We Collect When You Access the Website

When you visit the Website, we collect information sent to us by your computer, mobile phone, or other access device. This information includes:

  • Your IP address;

  • Device information, including but not limited to identifier, name, and operating system type;

  • Mobile network information;

  • Standard web information such as browser type and the pages accessed on our Website.

We collect this information to:

  • Administer our Website and personalize it for you;

  • Monitor and analyze trends, usage, and activities related to our Website, and provide third parties with aggregated and anonymized statistical information about our Users;

  • Prevent, detect, and investigate violations of this Privacy Policy and/or the Terms of Use, fraud, and other illegal activities.

2.2. Information We Collect When You Use the Website

When using our Website, you may be asked to provide certain personal information. If you refuse to provide the requested personal data, you may not be able to use certain features of the Website and our Services. We do not process personal data in a manner incompatible with the purposes for which it was provided. We use and process data strictly within the framework of the Terms of Use.

We may collect the following personal data:

  • First name, patronymic, and last name; date of birth; residential address; registered address; gender; marital status; passport series and number; photograph; data of an authorized company representative; company name; company details; contact phone numbers; email address; company location address; and other contact information voluntarily provided by the User;

  • User account information, including phone number, email address, login, password, and other data necessary for providing services and communication, including when contacting technical support;

  • Information provided when concluding service agreements by accepting a public offer published on the Website;

  • Information necessary for communication between Users, including for purchasing and confirming Online Certificates, sending and receiving messages, and making payments.

We collect this information to:

  • Register and identify the client as a User of the Website; communicate with Users; provide services; process payments; perform accounting operations; maintain accounting and management records; develop and implement loyalty programs; send mailings by post and email, including commercial offers, promotions, and news; improve service quality; analyze User activity; conduct keyword searches; manage Website traffic; analyze and forecast User preferences and interests; conduct other analytical activities; and ensure compliance with this Privacy Policy;

  • Prevent unauthorized access to personal data and fraud;

  • Comply with identification requirements;

  • Provide technical support, including registration or deletion of data, restoring access (lost password, login, blocked account or Partner’s personal cabinet), and assistance with other Website-related issues;

  • Personalize the Website;

  • Process statistical data regarding Website usage.

We may use your personal and other collected information to detect, investigate, and prevent fraudulent transactions and other illegal activities, develop new products and services, and verify compliance with the Terms of Use.

We may deny access to the Website if we have reasonable doubts about the validity or accuracy of the personal data provided.

We do not process data concerning racial or ethnic origin, political opinions, religious or other beliefs, or membership in public organizations.

2.3. Conditions for Granting Access to Data

Data disclosure occurs when a Partner publishes information about their Services and a Public Profile on the Website, or when a User accepts Partner Services, but only to the extent necessary for identification of the User and the service.

LLC “Jam Development” processes Data lawfully and fairly. Data is not disclosed to third parties without User consent, except in cases предусмотрених by Ukrainian law, in the interests of national security, economic welfare, and human rights, including when necessary for providing services.

2.4. How to Change/Delete Data or Withdraw Consent

Users may at any time change/delete personal information, unsubscribe from mailings, or withdraw consent to data processing through their Account or by sending a request to: support@discover.ua or by mail to: 03032, Kyiv, LLC “Jam Development,” 8 Symona Petliury St., apt. 6.

Upon receipt of such notice, data processing will be terminated and the data deleted, except where processing is necessary to protect the legitimate interests of LLC “Jam Development,” including protection against fraud or actions harmful to the Website or its Users, or where required by Ukrainian law.

Some Website features requiring User information may be suspended upon deletion or modification of data.

Data is processed and stored for as long as necessary to fulfill the purposes outlined in this Privacy Policy, but no longer than five (5) years from the date of the User’s last interaction with the Website.

2.5. Links to Third-Party Websites

Our Website may contain links to websites of partner networks, advertisers, Partners, etc.

If you follow such links, please note that these websites have their own privacy policies, and we are not responsible for those policies or any personal data collected through them. Please review their policies before submitting any personal data.

Our Website may also contain offers from Partners or service providers.

To complete transactions, Users may need to provide identification data (including payment details) to the relevant Operator, including consent to processing by such Operator. Such personal and payment data provided to third parties is collected and processed exclusively by the respective Operator and is not covered by this Privacy Policy. The Administrator does not collect or process payment identification data and is not responsible for transaction processing. This responsibility lies solely with the respective Operator.

SECTION 3. COOKIES

We use cookies and similar technologies (e.g., web beacons, Flash cookies) (“Cookies”) to enhance your Website experience. Cookies are small text files placed on your device by websites you visit. They are widely used to make websites work more efficiently and provide better, personalized service.

Cookies may be “persistent” or “session” cookies. Persistent cookies remain valid until expiration (unless deleted earlier). Session cookies expire when you close your browser.
